GENERAL TERMS AND CONDITIONS

 

  1. Current general terms and conditions form an integral part of the concluded agreement or the order placed, they take precedence over all other terms and conditions as well as over any documents, unless explicitly stated otherwise.

  2. All quotations, orders, sales and all other performance of services are subject to the following conditions known and approved by the customer, unless explicitly agreed otherwise.

  3. All prices and implementation modalities stated in any offers are without obligation until express acceptance by a proxy holder of PRIVATE DRIVING NV. Documents endorsed by non-authorized representatives of the company cannot bind this unless after written order confirmation by a proxy holder.

  4. The prices included in the quotations and offers are exclusive of the statutory VAT of 6%.

  5. Prices are calculated from departure at the depot until the moment of return to the depot, unless explicitly specified otherwise.

    In case of cancellation of a booked ride less than 24 hours before its planned start, PRIVATE DRIVING has the right to charge 50% of the normal price by way of fixed and irreducible compensation.

    Parking and toll costs are always borne by the customer and are added to the contractually determined prices.

    In case of assignments between 11 pm and 6 am, a surcharge of 15% will be charged on the normal prevailing rates;

  6. The customer releases PRIVATE DRIVING NV from any responsibility, and waives in advance any right to recourse or compensation, if any order could not be executed due to force majeure, strike, lock-out, unrest, natural disasters and in general all reasons beyond the control or the fault of PRIVATE DRIVING NV that makes it objectively impossible for it to fulfill its obligations towards the customer.

  7. The validity of any quotations is limited to 15 calendar days after their issue.

  8. The invoices are payable without discount within 15 days after the invoice date. In the event of non-payment or late payment of an invoice on its due date, a delay interest of 12% on an annual basis of the outstanding amount will be due by operation of law and without prior notice of default being required, where each started month will be considered as a full month.

    Also by operation of law and without prior notice of default being required, in the event of non or late payment of the invoice from the due date, fixed and irreducible compensation will be due: an amount of 10% of the outstanding balance with a minimum from € 75 Acceptance of bills of exchange, checks, promissory notes, staggered payments and other facilities do not in any way constitute a novation, such that these General Terms and Conditions continue to apply.

  9. In the event of not paying an invoice, PRIVATE DRIVING NV reserves the right to discontinue any further service to the customer concerned until full payment of the outstanding invoices.

  10. In order to be valid, any complaint regarding the goods and services invoiced by the invoice must be made by registered mail, and this within 10 calendar days after their delivery or performance. The date of the postmark will determine its timeliness.

  11. In the execution of its assignments, the drivers of PRIVATE DRIVING will strictly adhere to the current traffic regulations at all times.

  12. PRIVATE DRIVING reserves the right to take the safest and most comfortable route to the final destination, regardless of whether or not this would be the shortest route, without incurring irresponsible costs for the customer.

  13. The customer will ensure that no objects are left in the vehicle. In any case, he waives any recourse against PRIVATE DRIVING NV in the event of the disappearance of objects left in the vehicle.

  14. Damage to the vehicles caused by the passenger will always be fully and unabridged charged to the customer

  15. Transport by the passenger of dangerous and / or prohibited products in any way is strictly prohibited. In case of violation of this rule by the passenger, the customer will at all times be fully and unabridged liable for all damage of any kind suffered by PRIVATE DRIVING for that reason.

  16. Unless the customer expressly objects to electronic invoicing, the invoices of PRIVATE DRIVING will be sent electronically to the customers.

  17. All possible claims arising from the current invoice and / or the underlying delivery of goods and / or performance of services fall under the exclusive jurisdiction of the courts of the judicial district of Mechelen. This power is general and applies in particular to summary proceedings.
